Returning from PKV to GKV: Why Good Faith Doesn't Always Protect You

A recent ruling by the Landessozialgericht Berlin-Brandenburg (Regional Social Court) shows: if membership of statutory health insurance is based on false information, it can be at risk even if, according to the court's findings, the insured person was unaware of the forgery.

Key points at a glance

  • Switching from private to statutory health insurance requires that the statutory conditions are actually met.
  • Check all information and attachments before you sign an application – including documents prepared by third parties.
  • A membership that was initially confirmed offers no reliable protection of your status if key information later turns out to be false.
  • Don't cancel your existing cover too hastily; clarify the insurance-law and contractual consequences first.

What happened in the case

A self-employed carpenter over the age of 55 wanted to return to statutory health insurance in 2020 after several years in private health insurance. The application was accompanied by evidence of alleged previous insurance periods in Poland. According to the court's findings, this evidence was forged; according to those findings, the applicant knew nothing about it.

The health insurance fund initially accepted him. After a later check with the Polish insurance institution, it revoked the membership with effect for the future. While the Sozialgericht (Social Court) initially ruled in the man's favour, the Landessozialgericht Berlin-Brandenburg assessed the case differently.

In its ruling of 26 August 2026 (Az. L 16 KR 441/25), according to published reports, the court placed the interests of the community of insured persons above the insured person's trust in the continuation of his membership. An appeal on points of law was not allowed; in principle, a complaint against the refusal of leave to appeal may still be an option against this decision.

What the ruling means for you

The ruling does not mean that insured persons are automatically "liable" for every action of a third party. However, it does show that good faith does not protect the continuation of GKV membership in every case. What matters are the statutory requirements and the circumstances of the individual case.

If an intermediary, adviser or another person prepares documents, you should therefore still check the complete application and every attachment. This applies in particular to information on employment, income and previous insurance periods.

Possible consequences of incorrect or inaccurate information

Incorrect, incomplete or inaccurate information can have far-reaching consequences. Depending on the individual case, a health insurance fund may review or correct its admission decision or end a membership for the future. This can lead to gaps in health insurance cover or disputes about it. Returning to a previously cancelled private contract on unchanged terms is not automatically guaranteed either.

In addition, there may be premium claims, costs for legal clarification and – if deception or forged documents are involved – further civil, social-law or criminal investigations. Which consequences actually occur depends on who provided which information, what the person concerned knew and which statutory requirements were met.

Important: Even assumed good faith does not reliably protect you from unwelcome consequences. It may play a role in the legal assessment, but it replaces neither correct information nor the actual requirements for membership.

Your checklist before switching systems

  • Clarify the requirements: Have it checked on which statutory basis compulsory insurance or an option to join is supposed to arise.
  • Read all documents in full: Check the application, attachments and evidence. If documents are unclear or in a foreign language, ask for a comprehensible explanation.
  • Don't let anyone promise you shortcuts: Personal contacts or a verbal assurance do not replace a statutory requirement.
  • Don't end your existing cover too hastily: Before cancelling, clarify when the new cover takes effect and what consequences a later correction would have.
  • Keep documentation: Keep applications, advice records, evidence and correspondence.

Why the age limit of 55 matters

From the age of 55, returning to statutory health insurance is considerably more difficult in many situations. There is no one-size-fits-all solution: relevant factors include your insurance history to date, your current employment situation and the statutory exceptions. Whether access exists must therefore always be checked in the specific case.

Our perspective as an insurance broker

A switch of health insurance system should not be based on a supposedly simple construction. For us, the first question is whether the statutory requirements are demonstrably met and what long-term consequences the switch has for your cover.

If a return to the GKV is not possible, existing private health insurance should not be given up hastily. Depending on the contract, options such as a tariff change within the same insurer or other adjustments can be examined. Which option makes sense and is permissible depends on your personal situation and the specific terms.

Frequently asked questions about returning to the GKV

Can I still switch from PKV to GKV at 55 or older?

From the age of 55, returning to statutory health insurance is often considerably more difficult. Whether compulsory insurance or another form of access nevertheless exists depends on your specific employment and insurance history. A general answer is therefore not possible.

Does good faith protect me if documents are false?

Not necessarily. In the case described, the Landessozialgericht Berlin-Brandenburg gave greater weight to the interests of the community of insured persons than to the insured person's trust in the continuation of his membership. Other cases may have to be assessed differently in legal terms.

Should I cancel my PKV before the GKV has confirmed membership?

You should only cancel after careful examination. What matters is not just a confirmation of admission, but also whether the statutory requirements are actually and permanently met. If in doubt, have the insurance-law and contractual consequences checked.

What should I check in a switching application?

Check the complete application and every attachment, especially information on employment, income and previous insurance periods. Keep copies of the application, evidence, advice documents and correspondence. Don't sign anything you don't understand.

What options are there if a return is not possible?

In that case, it may make sense to review the existing PKV contract and possible tariff changes. Which options are suitable depends on your contract, your benefit needs and your financial situation. The standard tariff or basic tariff are only an option if the respective statutory requirements are met.
